What does this tell us?  Quite a lot!  Firstly, employees are very much aware of their rights

 

Society is becoming increasingly litigious and this has been encouraged by the growth of "no win, no fee" legal profession.

 

Your employees, even one's who have left your business or about to join, are able to bring a claim against their employer.

 

And the numbers make grim reading...

 

Over 200 separate changes to employment legislation have occurred over the last five years and this is set to grow as Europe plays a greater role in setting legislation.

 

UK Dept of Trade & Industry assess that less than 5% of employers have adequate protection.

 

In 2007, there were 130 000 Employment Tribunal applications.

 

Tribunal statistics show on Average an employer only has a 40% chance of successfully defending a Tribunal application (ET1 form).

 

The average cost per employer, per dispute, was estimated to be £20 000.

 

And it's not only this cost you have to think about!  Consider the money and time you will have to spend in preparing and defending your case at tribunal. A typical defence can often last SIX MONTHS to ONE YEAR, causing personal anxiety, lowering employee morale, loss of business focus and business profitability...often far greater that the award and associated legal costs.

 

And the stress of it all may wreck havoc with your physical and mental well being and cause unhappiness in the workplace and at home!
